I don't think anybody will be suing Brick Wall Corp. successfully. You cannot accidently stumble upon their property, its gated and all access points are piled about 10 feet high. Kids still get out there because there great places to ride, big sand piles to jump, etc. The Lacey police patrol out there pretty regular as do the NJ Conservation officers. Another terrible shame.

I recall that someone sued Heritage Minerals due to a jetski accident on Crystal Lake. I'm not sure if they won or not, but the fact of the matter is that you can sue anybody and cost them money in legal fees for just about any reason. I'm sure that someone will claim that they didn't post enough keep out signs, or were somehow negligent in keeping them out.

In any event, the other rider is going to be in a world of hurt if he doesn't have insurance and is somehow found to blame for the death.

As twisted as it seems, some lawsuits do get won in these circumstances.
Quite a few years back, a fellow that owned a great deal of property/orchards back this way was sued over the following:
A trespassing party, on a motorcycle, who had clearly ignored, signs, blockage, etc. had rounded a turn and crashed directly in to the land owner's tractor rounding the same turn in the opposite direction. He was injured badly and his family succesfully sued the landowner. He was very embittered over this and it showed the rest of his days.

Heres how it works

I am the nephew of butch, the guy who was killed in the accident this month. There is no dollar amount that could bring my uncle back and its sick to think thats all people acknowledge. We as a family will not take any legal actions he had permission to be on the property, and the guy who was with him is a wreck, it was his best friend a good friend of the family as well. Its a tragedy not a trial, we have to deal with our problems and move on with our lives.

We're all sorry for your loss, believe me. It is a public story, and people will discuss many aspects of it. The aspect most important to you, of course, is the personal one, and everybody will understand that.
