I've been having some trouble with people hunting too close to my house-(I have a house in a beautiful spot- 2.5 acres with woods all around-just a few miles from the Pine Barrens)and so I came online today to see if I could find out what the rules were with hunting (when, how far they have to stay from houses, etc.) and all I could find were Fish & Wildlife Sites that encouraged the practice and had "Oh, so pretty pictures of Dead Animals" all over their sites.

If my "anti-hunter" attitude is sticking out I apologize to anyone here that does it. I like to search out animals and birds to LOOK at them, not to kill them. I'll end that there.

Anyway, it was by chance that I found this site and wound up going back and reading hours worth of old posts.

I just want to say to whomever started this site that it was a GREAT Idea and I can see there's lots of great people here. I had to laugh when I saw the Lost In Space Robot as that was my favorite show when I was little. (I own the whole collection on tape.)

I look forward to "talking" to many of you. I'll be around for awhile reading as much as I can. I spend more money than I should feeding & watching the birds and last count had seen 64 different species in the 4 years I've been doing it.

Last week I had my most exciting "sighting" ever. I looked out & saw the
RED-HEADED WoodPecker, (not red bellied) One of the prettiest birds I've ever seen!

People should be able to enjoy themselves more in places like this instead of wasting hours of their time trying to see how many naked women they can look at on the internet without using their credit card!!!!! LOL

NJ Division of Fish, Game, & Wildlife is part of the DEP and has a section on their website.

You have (2) distinct problems/violations.

Hunters are required to have the permission of a land owner BEFORE hunting on private property. The former owner may have allowed them or not cared & I'd bet he did not "post" the boundaries w/ No Trepassing posters. They should be placed every 20 - 30 yds. all around the boundary.

Regulations require hunters to observe a 'Safety Zone' around any occupied dwelling. I seem to remember 450 ft. or 150 yds. BUT you need to check NJ's regulations as my hunter safety training was in Penna.

Hunters are extremly traditional and this group may have been hunting here, uninterupted, for years and they might be unaware of your landholding. While there is no excuse for getting too close [within 1.5 football fields] there is not too much to do about them entering the property until it is posted, unposted land could be misconstrued for permission. You may have noticed that fresh signs apear at the end of the summer. Some hunters lease the hunting rights to some land and post it signing the posters as so and so gun club when the real owner is your neighbor, the farmer. The same stores that sell No Tresspassing signs also have 'Safety Zone' ones too. I'd get them and put them up too. They need to be close, like every 20 -30 yards and could be on small wooden boards on posts driven into the ground in places where mother nature forgot to place enough trees.

Trepassing is a crime and the State Police & Game Wardens will come if called. Without posting the land they may not do much more than stirr up the locals and I'd sugguest not confronting a bunch of people with loaded guns...

If your birding hobby includes telephoto camera equipment that could get razor sharp pictures of that red headed woodpecker would also get readable pictures of the license tag. Hunters have to display their license in a holder on their back so it is visible. That wouild create visible evidence BUT I'd post the land first so they become aware of your boundary. Posters might just solve your problem.

If you have a hard time finding signs, check an Agway store, Home Depot might have them. Harry's Army & Navy, Rt 130, Hamilton, NJ has them. The signs are usually stapled or nailed onto trees facing out from your boundary so you won't see them as you observe the birdlife.

The law regarding safety zones in NJ is 450' from a "building" or school playground.
Here is the link to the section in the Game laws: http://www.state.nj.us/dep/fgw/pdf/2004/dighnt70-80.pdf You will have to scroll down a few pages to see the section on Safety Zones.
There is no longer any differentiation between dwelling or whether or not it is occupied.
The old law, when I was a kid, was 300' from an occupied dwelling.
The only exceptions to the current law are if the hunter possesses written permission from a landowner to hunt closer than 450'.
For the lay person, 450' is more than adequate for protecting against serious injury from the average small game load but is not nearly adequate to protect from buckshot, rifled slugs or muzzleloaders.
The hunter has to excercise extreme caution whenever and wherever he pulls the trigger.

Well, I got more information on the hunting laws by reading your replies then I did with all my searching yesterday.
Thank you very much for all the info. Do any of you know what these hunters are out shooting now-a lot of activity this week. Do I understand correctly that the only time for deer is around Christmas/Thanksgiving?

My location is very unique in that these hunters park at the end of the street on the cul-de-sac. I'm off a private drive which leads to this cul-de-sac. This spot is privately owned by a large builder who doesnt have any No trespassing signs etc. up. All the neighborhood kids play down there, basketball net, etc. including mine. These guys park their cars right on the dirt off the cul-de-sac, go through this private property and then I think they hunt right along the parkway although sometimes I know it's much, much closer than that. Many mornings, the kids would be waiting for the bus and would duck behind trees because the shots sounded so close. Other times they'd simply view these guys walk out the woods with a dead deer in tow which made them ill and myself too. It bothered me enough that I was tempted to run out and buy No Trespassing signs & put them up myself but it's not my place. A call to the builder once went unanswered. Basically I cant prove they come within 450 feet of my exact home but they are in the woods behind my yard-I'm just not sure how far........We had a family member whose neighbor was killed in her backyard by a stray shot, a mom of two kids that were under 5 years old. I dont go in the back yard during deer season=I'm too scared. I wanted to live here because of the wildlife -there are a lot of deer in this area. I brought it up at the bus stop once & found that two of my neighbors had told hunters in the family how plentiful the deer were around here so they could come down & shoot them so my opinion was not too valued. Oh well, didnt mean to be so lengthy. I know many people can come up with many reasons why there's nothing wrong with it and I dont want to sound hostile because I dont know any of you yet

I guess one day I'll have to start looking for him. My husband walked out on me a few months ago-I think it was some kind of early mid-life crisis!!! (Either that or he didnt like the fact I took in a stray cat which had 6 kittens-I fell in love with all of them, refused to give them away, and now they're scratching up the precious 6000 sq. ft. mansion he built here in the woods. He never should've said "It's me or the Cats!! I didnt mean to hurt his feelings with my answer but any animal lover knows what I had to say!!! LOL

Maybe I'll have to participate in your Pine Barrens Pin Up Girl Calendar to see if I can find Mr. Right after I recouperate(Spelling?)a bit. I'm a little on the short side but I've got the necessary D cups for the calendar requirements.

Bobbleton, you're lucky to have gotten ANY PICTURE of the red-headed woodpecker!! Usually by the time you run to get your camera, the good birds have flown away!! I think the reason he is so stunning, is there are no spots or stripes to "dull" the effect -just red, white & black-if that makes any sense.
I almost died when I looked out & saw him!!! Was that your only sighting of one? Does anyone know if those "telescopes with digital cameras built in" work well? I'm wondering about the quality. I just have a basic digital camera, a Canon A75-not much in the way of getting distance shots........

You could still post 'SafetyZone' posters at 450 feet from your home. that law applies to everyone, not just the land owner.

Due to the overabundance of deer in NJ the extended season ran until Feb 12th.

My neighbor was out on Sat & his 'club' ended the day w/ a huge beer bash [:-(] and he came home empty handed on Sunday w/ a huge head...Serves him right!

Penna only did this in a few counties around Philadelphia & Pittsburg to try & reduce the surburban population. The rest of the state only got the normal 'extended season' two weeks after X-mas...usually restricted to archery & muzzleloaders.

Get some posters up before the end of summer. These guys will come around scouting before Archery opens in September. If that does not help; Pep Boys and other auto stores sells a little tool that removes valve stems. Evacuate the air from a few tires & then tighten the valve again...Since the builder does not answer you; he may want hunters around so the homeowners don't loose too many shrubs.

Bruset, I see you have the Lost In Space Robot under your name. Did you like that show as a kid? I do have the entire series on video tape (Through Columbia we got it) and I don't mind admitting there's many episodes I can watch over and over again. (when the robot gets gigantic & Will goes in, When the family disappears one by one when Will says he wishes he was alone, when they think they're on earth but it's all a "duplicate earth." I know a lot of it was VERY CORNY and I laugh at it sometimes now as an adult but there was something addictive about it to me.

I have a big heart, big pickup trucks, love my wife, my dogs and the pines.
It's just that I like my wildlife neatly gutted, skinned, quartered and slow cooked with mushrooms, onions and gravy.

They're tongue in cheek. I think she is best to get safety zone signs and make sure she knows when the seasons run. The recient activity was probably due to the impending close of the season.

I was introduced to the out doors, around age 6 as my father & a friend who raised beagles & bassetts would take me along when they 'ran' the dogs before the small game season. I can still hear the bassetts sounding...

Since every male member of my family hunted, it was easy to get caught up in the traditions; especially in PA where the first day of deer was a school holiday.

My grandmother used to cook browned rabit in her spaghetti sauce...I haven't eaten that in 35 -38 years and I can still taste it. Try that sometime...the whole family loved it.
