In that case, it's the driver's fault for not looking to see that a train is coming. Getting shot by somebody when you're just minding your own business is another thing completely...
My last comment on this, No one from here was there so you have no idea what happen, only what the paper printed.People are so quick today to make judgement!

The train example is not a very good one if it is to show that accidents happen. It is a better example of the recklessness that most likely resulted in the reported hunting incident Most of these collisions are also not accidents at all, but rather a case of drivers deliberately breaking posted laws by ignoring train crossing signals or lowered gates because they are in a hurry or think they can outrun what appears to be a slow-moving train. Incidents commonly described as accidents are very often the result of ignoring safety rules or using bad judgment.

I have an analogy for what the hunter did. Suppose somebody told you to go get yourself a donut on the kitchen table. You go in and see the donut next to a glass ashtray.

He ate the ashtray.
