Mining company files $197 million insurance claim against Air Force over Stafford wildfire

A Warren Grove resource extraction company has filed a $197 million insurance claim with the Air Force following a wildfire four months ago.

Phoenix Pinelands Corp., a mining operation that specializes in sand and gravel sales, filed a two-part claim in August, said Angel Lopez, Public Affairs Specialist for McGuire Air Force Base.

The bulk of the filing, which seeks $187 million, is over damages to 260 acres of, "mineral reserve land,'' Lopez said. The remaining $9.8 million of the claim relates to 200 acres of burned forest.

The Phoenix claim represents the bulk of $200 million in outstanding filings with the Air Force following the May fire touched of by an errant flare from an F-16 flying a training mission at the Warren Grove Gunnery Range. The other $3 million in damage claims is spread over 160 claims, the Air Force said.

An employee answering the phone at Phoenix's Route 539 office today said the company has no comment on the claim.

Air Force insurance officers at McGuire are responsible for investigating all claims filed arising out of the fire, Lopez said. The base is responsible to pay or deny claims of up to $25,000. Larger claims are either denied by a claims and tort litigation division of the Air Force Legal Operations Agency or approved by the Judge Advocate General of the Air Force if between $25,000 and $100,000.

Payments greater than $100,000 must be approved by the Secretary of the Air Force.

Phoenix Pinelands - Unpatriotic !!!

We have owned a home in the town of Warren Grove, NJ for 30 years. .
It's become public, recently that the adjoining sand & gravel pit, Phoenix Pinelands, is suing the federal government for over $197,000,000 in damages to their property. The majority of their property is forested with scrub pines that burned in the fire. They're claiming lose of future income. Apparently they feel sand & gravel burn.
Considering the total claims from displaced residents only amounted to $3,000,000, you can see the amount Phoenix Pinelands is talking about for their few hundred acres of burned trees is outrageous.
There have been recent articles about the suit in the Atlantic City Press & Asbury Park Press that give greater details.
Trying to fleece the federal government (us taxpayers) over burned trees, during wartime, is unpatriotic, to say the least. This is truly an outrage to our military, the taxpayers & the many companies that do business with Phoenix Pinelands.
They haven't made the simple connection that the military operation next door to them actually allows Phoenix Pinelands to make money selling sand. It's called democracy, it's called freedom and people are dying for us to be able to "sell dirt".
Shame on you Phoenix Pinelands! Boycott the business folks!

I agree with you 1,000%. And, the trucks that pickup sand speed around like they own the roads. I agree, Shame on you Phoenix! Money is everything to you, but you gouge the hell out of the earth for people in North Jersey to have their Mansions, then try to fleece the government. I hope the judge fines YOU for wasting taxpayer money. You are a lousy neighbor.

Gravel company has largest claim from Pinelands fire

LITTLE EGG HARBOR TOWNSHIP, N.J. - Four homes were destroyed and 37 other damaged by a raging forest fire in the Pinelands last May, but a sand and gravel company is seeking more than 98 percent of the damages sought from the military for causing the blaze.

Prolonged exposure to heat as the result of fire can be economically devastating to a sand and gravel mining operation, Hugh Miller, a professor of mine engineering at the Colorado School of Mines, told the Asbury Park Press for Friday's newspapers.

"What occurs partially with raw materials is that there's a real tight specification with products and what customers want," he said. "When things get hot, their physical properties change."

They had to go all the way to Colorodo to find a guy to say that, and probably sent him $100 for the comment. When things get hot he says. The mines in my area are now 75 feet below median grade and raking the sand (money) in. Who in their right mind thinks that fire burned sand even 2 feet down, which would be removed and not sold anyway. Besides the fact that the water table there is maybe 10 feet down, maximum. Its right next to the Oswego River.

So I guess they are saying that there never was a fire in that area before and their sand is perfect. I can't see how a fire can alter the sand and cause that much damage.

Spot on, Guy. Our pinelands gravel has for thousands of years been subject time and time again to fires as bad as, and worse than, this most recent fire. These people ought be fined as Bob suggested and laughed out of court.

Golly, I can't understand why the public should be let on to the fact that 200 million of their dollars are at stake. :bang:
